1. General Terms of Use
Welcome to www.divine-helper.com (the "Website"). Please read these General Terms and Conditions ("Agreement", "Terms of Use") carefully before using www.divine-helper.com ("the Website") operated by Kobadu Holding ("The Organization", "us", "we", or "our"). This agreement sets forth the legally binding terms and conditions for your use of our Website www.divine-helper.com.
By accessing, using or visiting www.divine-helper.com, you acknowledge and confirm that you are authorized on behalf of yourself and your organization to agree to our general terms of conditions and Privacy Policy incorporated herein by reference. By using any of the Services or the Platform, you're agreeing to these Terms of Use. This means you understand and accept all the rules about using our Services. Whether you are contributing to a Fundraiser as a Donor, starting a Fundraiser, withdrawing funds as an Organizer or Beneficiary, or otherwise interacting with the Services, these terms apply to you. If you disagree with these general terms and conditions or any part of these general terms and conditions you must not use our website. These Terms of Service apply to all users, whether accessed via computer, mobile device, or other technology, manner, or means.
2. Description of the Services provided
We offer a Platform for individuals, entities, or nonprofits to create Fundraisers to receive monetary donations from Donors for themselves, or a third party Beneficiary. All these payments go via our website.
2.1 Our Role and Limitations
Our Services are a tool for running Fundraisers and for helping Organizers connect with Donors; we are not a bank, payment processor, broker, charity, or financial advisor. We do not solicit donations, the existence of the Services is not a solicitation of donations, and we do not engage in solicitation activities for ourselves or others on our Platform. We do not act in, or intend to act in, any capacity that requires registration, licensure, or compliance as a Professional Fundraiser, Commercial Fundraiser, or Professional Fundraising Counsel. All information provided through our Services is for your general knowledge and isn't meant to be professional advice. If you need specific advice, especially regarding financial, legal, or tax issues, you should consult with a professional. We do not control or endorse any User, Fundraiser, or cause, and we can't guarantee the success of a Fundraiser. As a Donor, it's up to you to decide if a cause is worth contributing to.
3. Registration and Account
In order to access features of our Service, you must create a user account to access and use the Platform ("User Account"). The online registration process requires you to provide accurate and complete information and promptly update this information. If you provide any information that is inaccurate or incomplete, or we have reason to believe that the information is inaccurate or incomplete, we reserve the right to suspend or terminate your account and your use of our service without any notice.
You acknowledge that only authorized users may use your account to use the service and conduct other activities with us on behalf of your organization.
You hereby acknowledge that when registering you will create an Account as the authorized representative of a campaign or an organization and that you are solely responsible for all activities occurring under your personal or organization User Account and for maintaining the confidentiality and security of its username and password. Please notify us immediately of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate your Account, or your access to the Service, with or without notice to you, in the event that you breach these Terms. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
4. Protecting your Privacy
Our current Privacy Policy explains how we handle and protect your personal information when you use our Website.
5. Payment Processors
Divine-Helper uses third-party payment processors to manage and process all donations for Fundraisers. To transfer funds to a Fundraiser, you must provide your bank account details to us and our payment processor partners. By making a Donation, setting up a Fundraiser, you agree to the processing, use, transfer or disclosure of data by the Payment Processors pursuant to these Terms of Service as well as any and all applicable terms set forth by the applicable Payment Processors. Our current Payment Processors include: Stripe, Inc. For more details, including how we handle data with these third party payment processors, please refer to our Privacy Notice.
6. Donor Support Protection
Divine-Helper protects donors by implementing stringent Trust and Safety checks, using encrypted payment gateways, and offering dedicated donor protection mechanisms. We use advanced fraud-prevention algorithms, verify campaign organizers and beneficiary identities, and monitor campaigns for suspicious behavior before releasing any funds. The main ways Divine-Helper secures and protects Donor support include:
- a. Identity Verification (KYC): Platforms require fundraisers to verify their personal details, legal name, and banking information before funds are ever withdrawn.
- b. Payment Encryption: Financial data is fully encrypted (often using TLS/SSL) during transmission to prevent unauthorized access, ensuring safe checkout.
- c. Trust & Safety Investigations: Dedicated teams actively monitor campaigns for signs of fraud, handle community reports, and can block or restrict accounts that violate terms of use.
7. Posting Campaign Advertisement Rules
Divine-helper.com is an online crowdfunding platform where a fundraiser can post a campaign and advertise it so that users can view these Advertised campaigns and react on it.
7.1 Creating and Posting Campaign Ads Rules
- a. Only one specific campaign may be offered or searched for in each Advertisement.
- b. Each title and each text of an Advertisement must contain a description of the offered campaign or the offered service.
- c. Titles and texts of Advertisements may only be drawn up in English.
- d. It is not permitted to have or have placed multiple identical Advertisements on the Website at the same time. It is not permitted to offer the same campaign in more than one Advertisement at the same time on the Website.
- e. If an Advertisement is removed from the Website before the end of the initial Advertising Period, it is not permitted to place an identical Advertisement or an Advertisement for the same object or service within the remaining term of the original Advertising Period.
- f. Each Advertisement must be placed in the best matching category.
7.2 Rules for Advertising content
- a. An Advertisement may not contain discriminatory, pornographic, abusive, threatening or inflammatory content.
- b. It is not allowed to place an Advertisement for the sole purpose of directly or indirectly promoting an organization.
- c. It is not allowed to place photos with an Advertisement that are not related to the campaign presented.
- d. Advertisements may only mention websites but not include links to third-party websites.
- e. It is not allowed to place advertisements that are only placed to generate clicks on a certain website.
- f. It is not allowed to present campaigns that are illegal or unlawful or whose donation is prohibited.
- g. Both Advertisers and Users should always pay close attention when presenting and responding to campaigns.
8. Paid Advertisement
8.1 Advertisement Packages
Our website has a free posting of campaigns with limited benefits but may charge a fee to post advertisement with more Advertising benefits. These benefits are grouped in different Paid Advertisement Packages including:
- Basic Package
- Plus Package
- Premium Package
Divine-helper is at all times entitled to change the rates of the Advertising Packages, as well as to change, limit or expand Advertising Packages, including but not limited to the functionalities and/or features thereof.
8.2 Fees and Compliance
The fee permits Paid Advertisement to be posted in a designated area of the Website. Each party posting Paid Advertisement to the Service is responsible for the Advertisement and compliance with these terms. Any such fees paid hereunder are non-refundable in the event any Advertisement is removed from the Service for violating these terms.
8.3 Payments of our Service
- a. When choosing the category or standout option, the corresponding price will be made known, if applicable.
- b. The obligation to pay the price applies from the moment the Advertisement is approved to be published. If payment is not made or is not made on time, Divine-helper is entitled to remove the placed Advertisement and still charge the amount due.
- c. If a payment is not made on time, Divine-helper is also entitled to charge statutory commercial interest.
- d. Divine-helper can change (parts of) the Website and the services at any time.
9. Rules for Completing and Posting Ads
- 9.1 An Advertiser places his/her Advertisement via the 'Post Advertisement' button on the Website. Before an Advertiser can post an Advertisement, he must first log in.
- 9.2 Establishment of an Advertising Agreement between Divine-helper and the Advertiser.
- 9.3 After the Advertiser has logged in, he/she can create an Advertisement via the 'Place Advertisement' button. The Advertiser can see a preview under the button 'View Advertisement'. After seeing the example, you can click 'Publish Advertisement'. This completes the advertising agreement between Divine-helper and the Advertiser.
- 9.4 Divine-helper stores all data from each Advertising Agreement for 14 days after removal of the Advertisement.
- 9.5 Advertisements will remain on the Website for the days as per the package, provided that the applicable (payment) conditions are met and the Advertiser does not remove the Advertisement itself.
- 9.6 If the campaign presented in the Advertisement funds raising goal is reached, the Advertisement must be removed and the Advertising Agreement between you and Divine-helper ends.
- 9.7 When preparing the Advertisement, the Advertiser has the option to make his Advertisement 'stand out' by choosing from different packages: Basic Package, Plus Package, and Premium Package.
9.8 Right of withdrawal
- a. The right of withdrawal may apply in certain cases to the Posting of an Advertisement. It does not apply to Advertisements removed under the provisions of the Terms of Use.
- b. Unless otherwise agreed, you agree that an Advertisement will be placed immediately, during the statutory cancellation period.
- c. If the right of withdrawal applies, you agree that if you make use of your right of withdrawal, you owe Divine-helper a proportional fee for the services provided.
- d. The dissolution period expires 14 days after the day on which your agreement with Divine-helper is concluded.
- e. You can exercise the right of dissolution by filling a form you can request with us and sending us a signed version by e-mail to support@divine-helper.com.
- f. If you exercise your right of dissolution, you are entitled to a proportionate compensation based on the remaining number of days of the advertisement. We will pay you this amount no later than 30 days after we received your decision.
10. Unauthorized use of the Website
The content of the Website may not be copied, reproduced and/or made public by the User except for RSS feeds for personal use and/or news items up to a maximum number of 100 Advertisements or 100 hyperlinks to Advertisements. The User is not permitted to change the content of the Website, other than as described in these Terms of Use. The User is not permitted to collect personal data from Users who Post an Advertisement on the Website (including email addresses and telephone numbers) and/or to approach Advertisers to offer their own campaigns and/or services.
11. Misuse of the Website and its Consequences
For your safety and to prevent misuse, e-mail addresses are protected by Divine-helper. Your response to an Advertisement and any follow-up messages between fundraiser and any user are sent via Divine-helper's servers.
11.1 To report illegal and infringing advertisements, offensive content and other problems, please email support@divine-helper.com.
If we receive instructions and/or complaints from other Users or if we believe for other reasons that a particular User does not act in accordance with the law and/or the Terms of Use, we can โ for security reasons and to protect our Users โ (a) exclude the relevant User from the services of Divine-helper or limit certain functionalities for this User; and/or (b) remove one or more Advertisements from the User without refund of the amount paid.
12. Intellectual Property Rights
- 12.1 It is not permitted to include a campaign in an Advertisement that infringes intellectual property rights of third parties.
- 12.2 Only the name of the campaign that is offered or requested in the Advertisement may be used in the title and text of the Advertisement.
- 12.3 Only the trade name of the organization from which the relevant campaign or service originates may be used in the title or text of the Advertisement.
- 12.4 The campaign may only be compared with other campaigns in the text of the Advertisement and not in the title.
- 12.5 It is not permitted to include a disclaimer in the Advertisement regarding the authenticity of the campaign presented.
13. Prohibition for Minors
The services of Divine-helper are only for 18+ and NGOs and are not accessible to underage Users.
14. Termination of Agreement
The User can in principle terminate his/her agreement with Divine-helper at any time by deleting his/her account, unless otherwise agreed in writing. After termination of the agreement with the User, Divine-helper may retain information about and data from the User's account to the extent permitted by Law.
15. Liability and Indemnification
15.1 We exclude, to the extent permitted by law, liability for all damage suffered by a User by:
- a. use of the services of Divine-helper;
- b. the non-availability or non-secure availability of the Website or parts thereof;
- c. incorrect information on the Website;
- d. purchase of services from third parties or use of campaigns purchased through the Website;
- e. changes in the services of Divine-helper or changes in or on the Website;
- f. acts by the User in violation of the Terms of Use and/or applicable laws and regulations.
If we are nevertheless liable for whatever reason, our liability is limited to a maximum of (a) the total compensation that the User has paid to Divine-helper during the 6 months prior to the act that caused the liability, or (b) $150, whichever is higher.
15.2 Every User indemnifies Divine-helper against claims from third parties with regard to damage suffered by: (a) entering into an agreement based on an Advertisement; (b) the receiving of donations via the Website; (c) the use of services offered through the Website; and (d) the (allegedly) infringing and/or otherwise unlawful nature of the Advertisement.
16. We make no guarantees
We cannot guarantee that our services will always meet your expectations. Nor can we guarantee that the Website functions without error and/or that continuous and/or secure access to the Website or parts thereof can be obtained. All information and numbers on the Website are subject to spelling or typing errors.
17. Arbitration
- 17.1 In the event of a dispute between a Business User and Divine-helper, the parties can try to reach an agreement through mediation.
- 17.2 Divine-helper is neither willing nor obliged to participate in proceedings before a consumer dispute settlement body but is willing to work with intermediaries to reach an amicable agreement.
- 17.3 Divine-helper and the User are free to appoint a mediator jointly chosen by them.
- 17.4 If the above actions have not provided any resolution, then the parties are allowed to proceed to legal proceedings.

Notices to Divine-helper (other than regarding infringing Advertisements) can be addressed to support@divine-helper.com or Divine-helper.com, Osu 224, 1097 DN in Accra, Ghana. Notices to Users will be sent to the email address provided, or by certified mail where appropriate and an address is available.
